The Workers' Minimum Standards of Housing, Accommodations and Amenities Act 1990 (Act 446) is Malaysia's primary legislation governing worker accommodation standards, administered by JTKSM under the Ministry of Human Resources (MOHR).
Employers providing accommodation for 5 or more workers must obtain a Certificate of Accommodation from the Director General of Labour before housing workers — verified through rigorous inspection of physical standards and facility requirements.
All applications are submitted through the official JTKSM portal at akta446.mohr.gov.my.
Accommodation compliance isn't just a standalone obligation — hostel certification is also checked as part of the foreign worker eQuota approval process, so gaps here can delay or block new quota applications.
Jabatan Tenaga Kerja Semenanjung Malaysia (JTKSM) under the Ministry of Human Resources (MOHR).
Federal legislation with enforcement powers including fines, imprisonment, and hostel closure orders.
Protect worker welfare by ensuring safe, healthy, and dignified living conditions in employer-provided accommodation.
The Certificate of Accommodation is the permit issued by JTKSM under Act 446 once a hostel passes document review and physical inspection. It confirms the premises meet minimum standards for space, sanitation, ventilation, and fire safety, and it must be displayed at the hostel.
It is a separate document from the Certificate of Completion and Compliance (CCC) issued under building law, which is one of the supporting documents an employer submits as part of the Act 446 application (see Step 2 below) — not the Act 446 certificate itself.
Act 446 compliance is a legal obligation, not a discretionary standard. Non-compliance carries severe legal, financial, and operational consequences.
Under Section 24D(1) of Act 446, employers whose foreign worker accommodation fails to meet prescribed minimum standards are guilty of an offence and, upon conviction, liable to:
Effective September 2026, employers must register and verify each foreign worker’s accommodation address via the FOMEMA portal. This requirement applies before PLKS issuance and is enforced under Act 446. Failure to register accurate housing details may result in levy forfeiture or permit cancellation.

Administrative review of submitted documents for completeness — typically 7–14 working days.
On-site inspection scheduled once documents are approved — allow 3–7 working days for coordination.
Inspectors verify actual conditions against submitted plans — room dimensions, sanitation facilities, utilities, and fire safety equipment.
Deficiencies (if any) require rectification and re-inspection. Otherwise, proceed to certificate issuance (5–10 working days).
Certificate of Accommodation issued, valid for 3 years. Must be displayed prominently at hostel premises.
Certification is not the end of JTKSM's involvement — officers carry out follow-up and complaint-triggered inspections at hostels throughout the 3-year validity period, not only at initial certification or renewal. A complaint from a worker, a workplace incident, or a routine labour audit can each trigger an unscheduled visit. Keep your hostel continuously compliant, not just audit-ready at renewal time — a mid-cycle failure carries the same Section 24D penalties as a failed initial inspection.
Space calculations must use actual usable sleeping area only — excluding bathrooms, corridors, and fixed furniture footprints.
